1. Legal Information

The application Hangugeo and the website hangugeo.com (together the “Application”) are published by:

Hereinafter referred to as the “Publisher”.

2. Purpose and Acceptance

These Terms of Use (“Terms”) govern access to and use of the Hangugeo Application, a Korean language learning platform, and define the rights and obligations of the Publisher and the User.

By creating an account and/or using the Application, the User unreservedly accepts these Terms. If the User does not accept all or part of the Terms, they must refrain from using the Application.

The Terms are available in French (binding version) and English. In case of any discrepancy, the French version prevails. The showcase website hangugeo.com is also translated into German, Japanese, Thai and Spanish for informational purposes only; those translations have no contractual value.

3. Definitions

  • Application: the Hangugeo Korean learning platform, accessible via the web app and the website hangugeo.com.
  • User: any natural person who accesses the Application, whether or not they hold an Account.
  • Account: the personal space created by the User to access the Application’s features.
  • Content: all lessons, exercises, educational materials, audio and video related to Korean language learning made available through the Application.
  • Free Version: a limited set of Content and features available at no cost.
  • Premium Subscription: paid plan giving access to an extended set of Content and features.
  • Premium+ Subscription: higher paid plan giving access to all Content and advanced features.
  • Free Trial: 7-day period during which the User may try the features of a Premium or Premium+ subscription at no cost.
  • Consumer: any natural person acting for purposes outside their trade, business, craft or profession.

4. Description of the Service

Hangugeo is a Korean language learning application offering: - Interactive lessons (hangeul alphabet, vocabulary, grammar, pronunciation); - Reading and listening comprehension exercises; - Personalized progress tracking; - [Other features to be completed].

The Publisher reserves the right to modify the scope of each tier; any substantial change unfavorable to existing subscribers shall apply only from the renewal of their subscription (and shall not affect lifetime purchasers).

5. Registration and User Account

5.1 Registration requirements

Creating an Account requires the following information: email address, password, first name or username, Korean proficiency level, preferred interface language (French or English), age range.

The User warrants the accuracy and truthfulness of the information provided and undertakes to keep it up to date.

5.2 Credentials

The User is solely responsible for keeping their credentials confidential. Any connection or action taken from their Account is deemed to be made by them. In case of unauthorized use, the User must notify the Publisher without delay at contact@hangugeo.fr.

5.3 One account per user

Each User may hold only one Account. Creating multiple Accounts may result in their suspension or deletion.

6. Minor Users

The Application is open to all ages, subject to the following conditions:

  • Users aged 15 and over: may register and use the Application autonomously, in accordance with Article 8 of the GDPR and Article 45 of the French Data Protection Act.
  • Users aged under 15 (and at least 13): registration requires the prior consent of the holder(s) of parental authority. During registration, the email address of a parent or legal guardian is required to collect this consent via double opt-in.
  • Users under 13: registration is prohibited. This restriction reflects in particular the requirements of the US Children’s Online Privacy Protection Act (COPPA).

The minimum age may be higher for Users residing in jurisdictions where local law sets a higher threshold (see Article 17).

The holder of parental authority remains responsible for the minor’s use of the Application and may at any time request the suspension or deletion of the minor’s Account by contacting contact@hangugeo.fr.

Any Premium or Premium+ subscription by a minor requires the express consent of the holder of parental authority, who alone is liable for the price.

7. Premium / Premium+ Subscription

7.1 Free Trial

Users subscribing to Premium or Premium+ for the first time benefit from a 7-day Free Trial starting from subscription.

During the Free Trial, the User has access to all features of the chosen subscription without any payment. At the end of the Free Trial, unless cancelled by the User before its term, the Subscription automatically switches to the paid plan and the first charge is processed.

The User may cancel the Free Trial at any time, free of charge and without justification, from their Account settings.

The Free Trial is offered only once per User. Creating multiple Accounts to obtain multiple Free Trials is prohibited.

7.2 Prices

Prices are shown in the Application at the time of subscription, inclusive of taxes where applicable, in the currency applicable to the User:

The Publisher reserves the right to modify prices at any time; any modification only applies to new subscriptions and renewals occurring after the change, with the User informed by email at least 30 days in advance. Lifetime purchases are not subject to renewal.

7.3 Payment

Payment is processed online by credit card (or other accepted means) through our payment provider Stripe Payments Europe Ltd (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland), which is PCI-DSS compliant.

The Publisher does not store any card data. Stripe acts as data controller for payment data, under its own privacy policy: https://stripe.com/privacy.

7.4 Duration and tacit renewal (monthly and annual plans)

Monthly or annual Premium and Premium+ subscriptions are concluded for the corresponding duration, renewable by tacit renewal for successive periods of the same duration, unless cancelled under Article 7.6.

Pre-contractual information (French Consumer Code, art. L.215-1 and L.215-1-1): Consumer Users may cancel their subscription at any time from the first renewal, without fees or penalties. The Publisher will send, no earlier than 3 months and no later than 1 month before the end of the period, a notice informing the User of the right not to renew.

7.5 “Lifetime” subscription (Premium+)

The “lifetime” Premium+ purchase grants access to Premium+ Content and features for an unlimited duration, subject to the existence and commercial operation of the Application by the Publisher. It is not subject to renewal. In the event the Application is permanently discontinued, the Publisher will notify lifetime users by email with reasonable notice and will consider compensation on a case-by-case basis in accordance with applicable law.

7.6 Cancellation by the User

The User may cancel their subscription at any time and free of charge: - From their Account settings (online cancellation, French Consumer Code art. L.215-1-1); - By email to contact@hangugeo.fr; - By postal mail to the Publisher’s address.

Cancellation takes effect at the end of the current subscription period. Unless mandatory laws of the User’s country of residence provide otherwise, no pro rata refund is due.

8. Right of Withdrawal

Under Article L.221-18 of the French Consumer Code, Consumer Users have a 14-day withdrawal period from the date of subscription to a Premium or Premium+ plan, with no need to give reasons.

Interaction with the Free Trial: subscription generally includes a 7-day Free Trial. During the first 7 days, the User may end the subscription at no cost. The 14-day withdrawal period runs in parallel and expires on the 14th day after subscription.

Exception: immediate performance and access to digital content. By subscribing to a Premium or Premium+ plan and accessing digital Content before the end of the 14-day period, the User: 1. Expressly requests that performance of the service begin immediately, including during the Free Trial; 2. Expressly waives their right of withdrawal once the supply of digital content has begun with their consent, pursuant to Article L.221-28, 13° of the French Consumer Code.

This double declaration is collected through a non pre-ticked checkbox at the time of subscription.

To exercise withdrawal rights where still applicable, the User may send an unambiguous statement to contact@hangugeo.fr or use the standard withdrawal form from Article R.221-1 of the French Consumer Code.

9. User Obligations

The User undertakes to: - Use the Application fairly and in accordance with its intended purpose; - Not infringe the rights of the Publisher or third parties; - Not attempt to circumvent the security measures or technical limitations of the Application; - Not extract, copy, reproduce or redistribute all or part of the Content for purposes other than strictly personal; - Not use robots, scripts or automated tools to interact with the Application; - Not share their Account with third parties; - Not use the Application for unlawful or fraudulent purposes.

10. Intellectual Property

All elements of the Hangugeo Application (educational Content, texts, audio, video, illustrations, “Hangugeo” trademark, logos, source code, databases, interfaces) are the exclusive property of the Publisher or its licensors and are protected by French intellectual property law and international conventions (Berne Convention, TRIPS Agreement).

The Publisher grants the User a personal, non-exclusive, non-transferable right of use, limited to the duration of their use of the Application, solely for the purpose of accessing the Content for personal Korean learning.

Any reproduction, representation, modification, commercial exploitation or redistribution of the Content, in whole or in part, is strictly prohibited without prior written consent from the Publisher.

11. Personal Data

Processing of the User’s personal data is governed by the Privacy Policy of the Application, accessible at hangugeo.com/privacy-policy, which is an integral part of these Terms.

12. Suspension and Termination by the Publisher

The Publisher may suspend or terminate a User’s Account, after a 15-day notice that has remained without effect (except in cases of urgency), in the event of: - Serious or repeated breach of these Terms; - Fraudulent or abusive use of the Application; - Inaccurate information provided at registration; - Non-payment of Premium or Premium+ subscription.

In case of termination for serious fault, no refund is due.

The User may also delete their Account at any time from the Application settings or by contacting contact@hangugeo.fr. Deletion is permanent and results in loss of access to progress data.

13. Liability

The Publisher undertakes to provide the service with due care, it being specified that this is a best-efforts obligation regarding educational quality and service availability.

The Publisher shall not be held liable for: - Service interruptions related to maintenance, force majeure or events beyond its control (network outage, AWS failure, etc.); - Indirect damages suffered by the User (loss of opportunity, loss of data, commercial loss, etc.); - Learning outcomes, which depend on the User’s personal investment and aptitude.

In any event, except in cases of gross or intentional fault, the Publisher’s liability is limited to the amount actually paid by the User in the 12 months preceding the event giving rise to the damage.

These limitations do not apply to personal injury, fraud, gross or intentional fault, or to cases where the law prohibits such limitation.

14. Modification of the Terms

The Publisher reserves the right to modify these Terms at any time to reflect legal, regulatory, technical or commercial developments. Users are notified of any substantial change by email or in-app notification at least 30 days before the new Terms take effect.

In case of disagreement, the User may cancel their Account and any Subscription, free of charge, within this 30-day period.

15. Consumer Mediation

Under Article L.616-1 of the French Consumer Code, Consumer Users residing in France or the EU may, free of charge, refer an unresolved dispute to a consumer mediator:

16. Force Majeure

Neither party shall be held liable for any failure to perform its obligations resulting from a case of force majeure as defined under Article 1218 of the French Civil Code.

17. International Users

17.1 Accessibility

The Application is published from France and hosted in France (AWS Paris region). It is technically accessible from abroad, and its showcase site is translated into French, English, German, Japanese, Thai and Spanish. The Publisher does not guarantee compliance with the local laws of every country from which the Application may be accessed. Users residing outside France are responsible for ensuring that their use is lawful under local law.

17.2 Currency, taxation and fees

Prices are displayed in the currency applicable to the User. Depending on country of residence, local taxes (VAT, GST, sales tax) may apply in addition or be included, in accordance with the applicable tax law. When the Publisher leaves the French VAT exemption regime, EU VAT rules under the One-Stop-Shop (OSS) scheme apply to intra-EU sales of digital services.

17.3 Mandatory consumer protections

Pursuant to Regulation (EC) No 593/2008 of 17 June 2008 (“Rome I”), Consumer Users residing in the EU benefit from the protection of mandatory provisions of the law of their country of habitual residence, where more favorable than French law.

Consumer Users residing in other jurisdictions (United Kingdom, Switzerland, United States, Canada, South Korea, Japan, Thailand, etc.) retain the benefit of mandatory consumer protections under their local law.

17.4 Restrictions

The Application may not be used from countries subject to international economic sanctions applicable to the Publisher (notably EU, UN, and where applicable US OFAC sanctions): currently including North Korea, Iran, Syria, Cuba, Russian-occupied regions of Ukraine.

18. General Provisions

18.1 Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Publisher regarding the Application.

18.2 Severability

If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18.3 No waiver

The Publisher’s failure to enforce any breach shall not be construed as a waiver of subsequent enforcement.

18.4 Assignment

The User may not assign their Account or these Terms to a third party without the Publisher’s prior written consent. The Publisher may assign these Terms in connection with any restructuring, merger, acquisition or business transfer, subject to prior notice to the User.

19. Governing Law and Jurisdiction

19.1 Governing law

These Terms are governed by French law, without prejudice to the application of mandatory consumer protection rules of the Consumer User’s country of residence (Rome I Regulation, art. 6).

19.2 Jurisdiction

For business Users: any dispute shall be submitted to the exclusive jurisdiction of the Tribunal judiciaire de Créteil (Val-de-Marne, France).

For Consumer Users: pursuant to Articles 17 to 19 of Regulation (EU) No 1215/2012 (“Brussels I bis”), the Consumer User may, at their option, bring proceedings before: - The courts of the Member State where they are domiciled; or - The French courts (Tribunal judiciaire de Créteil).

The Publisher may only bring proceedings against a Consumer User in the courts of the Member State of the User’s domicile.

19.3 Amicable resolution

Before any litigation, the parties shall endeavor to resolve any dispute amicably. The User may send their complaint to contact@hangugeo.fr. Failing resolution within 30 days, the dispute may be brought before the competent court, without prejudice to mediation under Article 15.
